Terms and Conditions

These Terms govern your use of Thriveful’s software, dashboards, and Services.
By accessing or using Thriveful, you agree to these Terms.

1. Definitions

• “Services”: Brand Archetype Discovery™, Brand Core System™, Brand Clarity Engine™

• “User”: any person with a Thriveful account

• “Content”: any text, uploads, audit inputs, or brand documents you submit

• “Subscription”: monthly or annual paid plans

• “AI Outputs”: content generated by the Services

2. Use of the Services

You may use Thriveful only for lawful purposes and in compliance with these Terms.

You agree not to:

• Attempt to reverse engineer the platform

• Use AI outputs to create malicious or harmful content

• Share or sell your account access

• Attempt to circumvent billing, usage limits, or rate limits

3. Accounts & Authentication

You must provide accurate information when creating an account.
You are responsible for securing your login credentials.

Authentication is provided via:

• Email login

• Google OAuth

• Clerk (identity & session management)

4. Subscription & Billing

A. Payment

Subscriptions renew automatically until canceled.
Billing is handled via Stripe.

B. Refunds

Thriveful does not offer refunds for:

• Partially used subscription periods

• Early cancellations

• AI output dissatisfaction

C. Free Trials

Free trials (if offered) convert automatically unless canceled.

D. Usage Limits

Plans may include:

• Audit limits

• API call limits

• AI generation limits

• Seat/user limits

Exceeding limits may require an upgrade.

5. AI Output Ownership

You own the content you submit and the AI outputs generated for you, with the following conditions:

• Thriveful retains rights to store and process inputs to deliver the Service

• Thriveful may use anonymized usage patterns to improve features

• You may use generated content commercially

Thriveful does not claim ownership over your Brand Core or audit results.

6. Acceptable Use of AI

You may not use Thriveful to:

• Create illegal, hateful, or deceptive content

• Generate misinformation

• Harass individuals or groups

• Conduct competitive scraping

• Automate spam

Violations may result in account suspension.

7. Termination

We may suspend or terminate accounts for:

• Violations of these Terms

• Abuse, fraud, or API misuse

• Failure to pay

You may terminate your account at any time through the dashboard.

8. Limitation of Liability

To the maximum extent permitted by law:

Thriveful is not liable for:

• Loss of revenue, profits, or business

• Mistakes or inaccuracies in AI-generated content

• Downtime or service interruptions

• Loss of data due to user error

Total liability is limited to the amount paid in the past 3 months.

9. Disclaimer

The Service is provided “as is” without warranties of any kind.
AI outputs may be incorrect or incomplete.
You are responsible for reviewing and verifying all outputs.

10. Governing Law

These Terms are governed by the laws of the State of Georgia.
